How to Participate in Bank Property Auctions in Cyprus: A Step-by-Step Guide

How Do You Participate in Bank Auctions in Cyprus?
Bank auctions in Cyprus follow a common set of rules established by the legislation on the transfer and mortgage of immovable property. Individuals and companies, including non-residents, may participate provided they are entitled to acquire property in Cyprus. The steps below outline the process from finding a property to registering ownership.
Step 1. Set Your Budget and Decide How to Pay
Before looking for auction properties, decide how much you are prepared to pay and arrange the funds. Auctions usually require a deposit to be paid promptly, with the balance due within a specified period. If you intend to use a loan, it is advisable to obtain bank approval in advance. Non-residents from outside the EU should consult a lawyer beforehand to establish whether permission from the Council of Ministers is required.
Step 2. Find Auction Notices
The sale of mortgaged property is announced through a public notice. You can find auction properties:
- on the official electronic auction platform where bidding takes place;
- on the websites of banks and asset management companies that publish property lists and auction dates;
- through aggregators and directories that collect notices (they do not conduct auctions or accept bids);
- through agencies and lawyers who monitor new auction listings.
The notice specifies the property type, area, share of the property being sold, land registry details, auction date and time, organiser (the bank or creditor) and starting price.
Step 3. Read the Notice and Auction Terms
Read the terms carefully: they determine whether you can withdraw without financial loss. Pay attention to:
- the starting price and bidding increment;
- the deposit amount and refund procedure if you do not win;
- the deadline for full payment after winning the auction;
- the consequences of failing to meet the terms, including loss of the deposit;
- the property description: the ownership share (the whole property or only part of it), any encumbrances and the status of the land.
Step 4. Carry Out Property Checks
Checks are carried out before the auction, not afterwards. A lawyer obtains land registry information on the owner, mortgages, memos and court restrictions, and also checks building permits and outstanding debts. Where possible, the property is inspected externally and sometimes internally. Access is not always available, and this should be taken into account when setting your maximum price.
Step 5. Register on the Platform
To participate in an electronic auction, you need to register on the auction platform. You will usually need to verify your identity and provide documents: a passport, proof of address and, for companies, incorporation documents and evidence of the representative’s authority. It is best to complete registration in advance, as verification takes time. The exact document requirements and verification procedure are specified on the platform itself.
Step 6. Pay the Deposit
To gain access to bidding on a particular property, a participant pays a deposit. The amount and payment details are specified in the auction terms. Payment should be made in advance so that the funds arrive before the auction begins. Deposits are returned to unsuccessful bidders in accordance with the procedure set out in the terms.
Step 7. Take Part in the Auction
At the scheduled time, log in to the platform and place your bids. Set your maximum price in advance and do not exceed it: it is easy to overpay in the excitement of bidding. The participant offering the highest price wins. If no bids are submitted or the price does not reach the required level, the auction is unsuccessful. The creditor may then take other steps to sell the property, such as holding another auction or arranging a direct sale.
Step 8. Pay the Balance and Complete the Transaction
After winning, you must pay the outstanding balance within the specified period. The transaction is then processed through the Department of Lands and Surveys. The deposit is usually credited towards the purchase price. A lawyer assists with registering the transfer of ownership and checks that the mortgage and other entries relating to the property are discharged or removed in accordance with the prescribed procedure.
If you do not complete the transaction, the organiser is entitled to retain the deposit. It is therefore sensible to bid only on properties that you have checked and can afford to purchase.
Step 9. Take Possession and Obtain the Title Deed
Once registration is complete, you become the owner. You will then need to connect utilities or transfer the accounts into your name, insure the property and, if it is occupied, arrange for it to be vacated. The latter may take time and require legal action, so allow additional time in advance for occupied properties.
Points to Consider When Participating
- Prepare your documents and platform access in advance so that you do not miss the auction.
- Calculate your total budget: the auction price plus taxes, transfer fees or VAT, stamp duty, legal fees and any renovation costs.
- Compare the price with the market value of similar properties in the area rather than relying solely on the starting price.
- Auction rules and debtor protections have changed recently, so refer to the current terms specified in the notice and on the platform.
- Make payments only through the official platform and using the payment details provided in the notice.
