Buying an Apartment in Cyprus Without a Separate Title Deed: What Does It Mean?

The apartment suits your budget and preferred location, but the seller says: “There is no separate title deed yet.” Does that mean you cannot buy it? Before deciding, establish why the deed is missing, the property's legal status and the conditions under which ownership can be transferred to you.

“Without title deeds” can describe different situations: an apartment under construction, a completed property awaiting separate registration or a property with unresolved issues. These situations should not be assessed in the same way.

What is a title deed in Cyprus?

“Title deed” is the commonly used term for a certificate of registration of immovable property issued by the Cyprus Department of Lands and Surveys. When buying an apartment, establish whether the specific unit has its own separate registration.

A deed for the land or an undivided share in it should not automatically be treated as a separate title deed for the apartment. Registry information, plans and the property's description in the contract need to be compared.

The Department of Lands and Surveys explains that an individual unit still under construction cannot yet have a separate certificate of registration. If construction is complete but a deed has not been issued, the buyer should establish why.

Is a sale contract the same as a title deed?

No. The contract sets out the parties' obligations. Depositing it with the Department of Lands and Surveys is a separate legally significant step. Registering ownership in the buyer's name is another stage.

It is therefore important to distinguish three events:

  1. Signing the sale contract.
  2. Depositing the contract with the Department of Lands and Surveys.
  3. Registering ownership in the buyer's name.

Receiving the keys and being able to use the apartment do not establish that the final stage has been completed.

Can you buy an apartment without a separate title deed?

A purchase may proceed through a sale contract where an immediate transfer of title is not possible. The Department of Lands and Surveys expressly describes this approach, including for property under construction.

Depositing the contract enables the buyer protection mechanisms under the Sale of Immovable Property (Specific Performance) Law to apply. However, depositing it does not itself confirm that the property is free of encumbrances, that construction complies with permits or that a separate deed will be issued by a guaranteed date.

The key question for a buyer: ask not only whether a deed exists, but why it has not been issued, what steps remain and what evidence supports the prospect of completing the registration.

Three situations to distinguish

1. The apartment is under construction

Discuss the permits, the seller's rights, encumbrances and the subsequent registration process with your lawyer and technical adviser. The contract should address construction completion, handover and title deed arrangements separately.

2. The building is complete and separate deeds are being processed

Request evidence of the current stage: which applications have been submitted, which approvals have been obtained and what remains outstanding. “The paperwork is in progress” is not enough to assess the position.

3. The property has been occupied for years, but the reason is unclear

Before making financial commitments, establish whether the delay relates to permits, deviations from approved plans, encumbrances, incomplete procedures or other issues. Your assessment should rely on documents, not the building's age or the seller's assurances.

Which documents should you check before paying a deposit?

Ask the seller to provide documents to an independent lawyer acting for you. The scope of the review depends on the property, but the following questions provide a useful starting point.

  • Who is the registered owner? Is this the seller, or is the seller assigning rights under an earlier contract?
  • What exactly are you acquiring? An apartment, a share in property or contractual rights must be clearly distinguished.
  • Are there encumbrances or prohibitions? Obtain current registry information.
  • Which permits have been issued? Review the approved plans and the property's actual condition.
  • How are parking and storage documented? Establish their status from plans and documents, not just the listing description.
  • What stage has the title deed process reached? Request evidence of completed and outstanding steps.

What is a Search Certificate, and why does it matter?

A Search Certificate with Encumbrances and Prohibitions provides registry information about encumbrances and prohibitions affecting the property.

Amendments that came into force on 12 December 2023 require the relevant certificate to form an integral part of the sale contract. For contracts being concluded now, the prescribed timing requirement must be observed: the certificate must be dated within five working days of the contract date.

Arrange the search before signing so that its findings can inform your decision and payment terms. An identified mortgage should not be treated as discharged merely because the seller promises to remove it.

When should the sale contract be deposited?

The Department of Lands and Surveys' published conditions specify six months from signing. Late deposit requires an appropriate court order.

This deadline should not be treated as a recommendation to wait six months. Establish in advance who will deposit the contract, when they will do so and what confirmation you will receive.

Can you later sell an apartment without a title deed?

In certain circumstances, a buyer's contractual rights and obligations can be transferred through an assignment agreement. This is a separate legal procedure, rather than an ordinary transfer of an existing registered title to a new owner.

If you are buying through an assignment, check the original contract, its deposit, payments already made, outstanding obligations and encumbrances.

What should the purchase contract address?

Before signing, discuss with your lawyer how the contract answers the following questions:

  1. How are the apartment, parking, storage and associated rights precisely identified?
  2. Which registration-related steps must the seller complete?
  3. How will the buyer receive updates on the process?
  4. What deadlines and consequences of delay are provided for?
  5. How is the payment schedule linked to fulfilment of the obligations?
  6. How will any identified encumbrances be addressed?
  7. What remedies are available if registration is not completed?

In its buyer guidance, the Department of Lands and Surveys advises against paying the full purchase price before title is transferred into the buyer's name. If the proposed schedule requires full payment earlier, discuss the implications and specific protections with an independent lawyer before accepting that obligation.

Which statements from a seller need clarification?

  • “The deed will be ready soon.” Ask about the current stage and supporting documents.
  • “Everyone in the building bought this way.” Request information relating to your particular apartment.
  • “There is a title deed for the land.” Establish what is registered and what will be transferred to you.
  • “We will remove the mortgage after payment.” Agree a documented arrangement with your lawyer and the relevant lender.
  • “You do not need a lawyer; the contract is standard.” Arrange an independent review before signing and paying.

Frequently asked questions

Does a missing title deed mean that the apartment is illegal?

Not necessarily. The reasons can differ. Construction legality and the ability to complete registration must be assessed using the permits, registry information and documents for the specific property.

If a title deed exists, are further checks unnecessary?

Further checks are still needed. Review the current registered owner, encumbrances, property description and whether the actual property matches its documents.

Can I get a mortgage on a property without a separate title deed?

Ask your chosen bank to assess the specific property. Preliminary mortgage discussions should not be treated as approval of the property as security for the loan.

How long does it take to obtain a separate title deed?

There is no single timetable for every property. An assessment requires information about permits, construction completion, submitted applications and unresolved matters.

Is a lower price for an apartment without a deed a good deal?

Assess the discount alongside legal certainty, potential expenses, registration timing and future resale arrangements. A low price does not itself compensate for an unclear legal status.

A practical starting point: before paying a deposit, obtain a written explanation of the property's status, the findings of an independent review and a clear account of the remaining registration steps. This allows you to compare apartments on more than price and photographs.
